These Terms of Use ("Terms") constitute a legally binding agreement between you ("Traveler," "you," or "your") and NyotaDrive Tours & Travel ("NyotaDrive," "we," "us," or "our"), a Kenyan tours and travel company headquartered in Karen, Nairobi, Kenya.
By creating an account, submitting a booking inquiry, or completing a tour reservation through our website at nyotadrive.com (the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Platform or make any booking with NyotaDrive.
"Tour" means a guided travel package, day trip, multi-day safari, cultural experience, or other travel itinerary offered by NyotaDrive as described on the Platform.
"Booking" means a confirmed reservation of a Tour, created by completing the booking form on the Platform and paying the required deposit or full payment.
"Travel Date" means the date you have selected for the departure or start of your Tour, as specified in your Booking confirmation.
"Traveler" means the person who creates a Booking through the Platform, and all individuals included in that Booking.
"Platform" means the NyotaDrive website, web application, booking system, and all related services and content at nyotadrive.com.
NyotaDrive provides guided tour packages across Kenya and East Africa, including wildlife safaris, beach holidays, cultural experiences, mountain treks, and city tours. Tour details — including itineraries, inclusions, exclusions, pricing, group sizes, and departure dates — are described on each Tour's listing page on the Platform.
NyotaDrive acts as a tour operator. We are not a travel insurance provider, airline, accommodation chain, or visa processing service. We strongly recommend that all Travelers obtain comprehensive travel insurance before departure.
You must be at least 18 years of age to make a Booking. By completing a Booking, you represent that:
(a) You are at least 18 years old and have the full legal capacity to enter into binding contracts in your jurisdiction;
(b) All information you provide is accurate and complete;
(c) You are booking on behalf of yourself and any other persons included in the Booking, and you accept these Terms on their behalf as well.
Children under 18 may participate in Tours when accompanied by a responsible adult Traveler who accepts these Terms. Certain Tours may have minimum age requirements as stated in the Tour description.
5.1 Booking Process. A Booking is initiated by selecting a Tour, choosing a Travel Date, specifying the number of travelers, and submitting the booking form on the Platform. A Booking is confirmed only upon receipt of the required deposit or full payment and our written confirmation sent to your registered email address.
5.2 Pricing. All prices are displayed in United States Dollars (USD) unless otherwise stated. Prices are per person and include the items listed under each Tour's "Includes" section. Items listed under "Excludes" — including but not limited to international flights, travel insurance, visas, personal expenses, tips, and items of a personal nature — are not included.
5.3 Payment. Payment is processed securely through our payment system. NyotaDrive does not store your full payment card details. By completing payment, you authorize NyotaDrive to charge the specified amount for your Booking.
5.4 Booking Confirmation. Your Booking is confirmed when you receive a confirmation email from NyotaDrive containing your booking reference number, Tour details, and Travel Date.
6.1 Cancellations by You. You may cancel your Booking at any time by contacting us at hello@nyotadrive.com. The following cancellation policy applies:
(a) Cancellation more than 30 days before the Travel Date: full refund, less a 10% administrative fee;
(b) Cancellation 15–30 days before the Travel Date: 50% refund;
(c) Cancellation 7–14 days before the Travel Date: 25% refund;
(d) Cancellation fewer than 7 days before the Travel Date: no refund.
6.2 Cancellations by NyotaDrive. If NyotaDrive cancels a Tour due to insufficient bookings, unsafe conditions, or events outside our control, you will receive a full refund or the option to rebook on an alternative date at no extra cost.
6.3 Modifications. We may modify Tour itineraries, accommodation arrangements, or transportation when reasonably necessary due to weather, road conditions, park regulations, or other operational factors. We will notify you of material changes as soon as practicable. Where a modification significantly alters the Tour, you may cancel for a full refund.
6.4 No-Shows. If you fail to appear at the designated departure point on your Travel Date without prior cancellation notice, no refund will be issued.
7.1 Travel Documents. You are solely responsible for ensuring that you and all travelers in your Booking hold valid passports, visas, entry permits, health certificates, and any other documentation required for travel to Kenya and any other destination included in your Tour. NyotaDrive does not accept liability for any costs, losses, or consequences arising from inadequate or invalid travel documentation.
7.2 Health and Fitness. Certain Tours require reasonable physical fitness. You are responsible for ensuring that you and all travelers in your Booking are in good health and physically capable of participating in the Tour you have booked. You should consult your physician regarding any health considerations, including required or recommended vaccinations for travel to Kenya.
7.3 Travel Insurance. We strongly recommend that all Travelers obtain comprehensive travel insurance prior to departure, covering medical emergencies, evacuation, trip cancellation, and baggage loss. NyotaDrive is not responsible for any costs arising from incidents that travel insurance would otherwise cover.
7.4 Conduct. All Travelers must respect the natural environment, local customs, wildlife, conservation rules, and the rights of local communities. NyotaDrive guides have the authority to exclude any Traveler from a Tour whose conduct is disruptive, dangerous, or disrespectful, without refund.
NyotaDrive shall not be liable for any failure or delay in performing its obligations under a Booking where such failure or delay is caused by events entirely beyond our reasonable control, including but not limited to: acts of God, extreme weather, natural disasters, park closures by the Kenya Wildlife Service or other authorities, civil unrest, government travel advisories, disease outbreaks, or border closures.
In such circumstances, NyotaDrive will make reasonable efforts to offer alternative dates, alternative Tours, or a credit toward a future booking. Where a full refund is not legally required, NyotaDrive's liability is limited to the Tour price paid, less non-recoverable costs already incurred.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NYOTADRIVE AND ITS EMPLOYEES, DIRECTORS, GUIDES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR PARTICIPATION IN ANY TOUR, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, ILLNESS, PROPERTY DAMAGE, LOSS, THEFT, WILDLIFE ENCOUNTERS, OR TRAVEL DISRUPTIONS.
NyotaDrive's total aggregate liability for any claim arising under these Terms shall not exceed the total amount paid by you for the specific Booking giving rise to the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
All content on the Platform — including text, photographs, itineraries, maps, logos, and design — is the property of NyotaDrive or our licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any Platform content without our prior written consent.
These Terms are governed by and construed in accordance with the laws of the Republic of Kenya, without regard to conflict-of-laws principles. Any disputes arising under these Terms shall first be referred to good-faith negotiation. Unresolved disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
NyotaDrive reserves the right to update these Terms at any time. Material changes will be communicated via email to your registered address or by a notice on the Platform at least 14 days before taking effect. Your continued use of the Platform after the effective date of any revision constitutes acceptance of the updated Terms.
